Dear Councillor Craske,

COMPLAINT OF MISCONDUCT BY ELWYN BRYANT


We have received a complaint from local resident Mr. Elwyn Bryant about alleged misconduct by you which we propose investigating.

COMPLAINT

The Complaint is that at the full Council Meeting on Wednesday 17 November 2010 at the Civic Offices Bexley when answering a question from Mr. Bryant you:

2.1 Were disrespectful towards Mr. Bryant by referring to the number of votes he received in the last Council elections for Councillors by saying “He only received 220 votes in the Council elections” or words to this effect, the object of which was to be rude, insulting and offensive to Mr. Bryant.

2.2 You made a false and misleading statement to the full Council Meeting when you informed it that there is “No four million pound contract with Parsons Brinckerhoff“ or words to this effect, although the 30 July 2010 issue of the official journal of Bexley Council Bexley Bulletin specifically states on page 6 that:

“The consultancy’s four-year contracts cover all transportation and traffic engineering services and traffic data collection services in the Borough and are worth approximate £4 million”.

A copy of the issue of Bexley Bulletin containing this evidence against you is attached, which is also available on the Council’s website.

The Tribunal that will hear these complaints against you will be constituted of three local residents and two Bexley Councillors of your choice.

The Chairman will have a casting vote.

The hearing of the complaints against you will be held in public where tape recording and videoing will be permitted.

The Tribunal will in accordance with the recommendations of the Standard Boards for England to the Government as to the constitution of Local Authority Standards Board namely:

“The Government should introduce, as a matter of urgency, secondary legislation to require a majority of independent members and an independent chair for Standards Committees and sub-committees in England.”

The Tribunal decision will be by a majority vote. The Chairman will have a casting vote. The person making the complaint cannot be a member of the Tribunal.

We should be glad if you would kindly let us know which two Councillors you wish to sit on the Tribunal and which dates are available for you to attend the hearing of the above complaints against you within the next two months.

If you do not respond to this letter in writing within 14 days then the hearing will have to take place in your absence, but we would much prefer you to attend with two Councillors of your choice so that you can fully respond to the above complaints against you.

Should you wish to admit now that you were offensive and rude to Mr. Bryant and that the statement you made to the full Council meeting that there is “No four million pound contract with Parsons Brinckerhoff” was false, misleading and untrue, then there would be no need for you to attend the hearing of the above complaints against you.

If there is anything that we have not made clear in this letter, please do not hesitate to let us know.

Meantime, we should be glad if you would kindly acknowledge receipt of this letter as soon as possible.
